One Year Limited Warranty

This One Year Limited Warranty applies and is limited as follows:

We warrant to you that our materials and workmanship will be free from material defects for a term of one year from the date of completion. For greater certainty, this warranty covers only material defects in our materials or workmanship and will not apply in the event of any damage or loss arising directly or indirectly, in whole or in part, from: (i) roof leaks; (ii) plugged roof vents; (iii) insulation near lower and upper roof vents being displaced by too much air flow creating light or bare patches in or around the vent locations (iv) faulty interior attic penetrations, including bathroom fan duct connections at base and roof connection; (v) bathroom fan ducts filled with water and or condensation (vi) bathroom fan malfunction (vii) not having the appropriate volume of air circulated to properly push exhaust from fan through the ductwork and out the roof vent (viii) any air leakage from house to attic space, any work performed or materials provided by a third party; (ix) if you have failed to follow our oral or written instructions regarding maintenance and care; (x) if the materials have been subjected to abuse, accident, act of god, abnormal environmental conditions or use contrary to our instructions; (xi if the materials have been repaired or altered by another person.

In the event of a valid warranty claim we shall, in our discretion, either: (i) perform such repairs or replacements as may be necessary to cure the defect; or (ii) credit or refund the sum necessary to repair or replace the defect to a maximum of the contract price. These remedies are the sole and exclusive remedies under this warranty and our entire liability for a breach of the limited warranty set out herein. Except for the warranties set forth above, we make no condition or warranty with respect to the materials and workmanship provided.

General Terms and Conditions

Liability:

Advance Insulation Canada shall not be responsible for any damages, either before the commencement of or during the work described herein due to delays, transportation difficulties, priorities, strikes, accidents, war, act of God, fire, sudden rain, storms, windstorms, other casualty or theft or other causes beyond its control.

Advance Insulation Canada will exercise reasonable care when performing the work in accordance with industry standards. Advance Insulation Canada shall also not be held responsible for any water damage to the interior or exterior building or premises upon or in which such work is done; or any damage to said work cause by settlement, shifting, expansion, moving, warping, distortion, or failure of any structure, roof deck, walls, floors, ceilings, or foundations of said building.

Any surplus materials remaining after completion of this job shall remain property of Advance Insulation Canada and no credit is due to customer with respect to such excess material.

The customer indemnifies and holds harmless Advance Insulation Canada and its employees, agents, authorized independent contractors and their subcontractors from any and all claims as to the identification, detection, abatement, encapsulation or removal of asbestos, lead-based products, mold or other hazardous substances inside or outside of the structure being improved.

Customer shall provide clean water and necessary electricity.

Change orders:
Any extra or additional work which is requested by the Customer or required due to the condition of the building or building code changes shall be performed only after a written change order, is signed by the customer on the Advance Insulation Canada’s change order form and delivered to Advance Insulation Canada by way of email or in person. A change order may increase or decrease the price, provided for more or less time to complete work, for more or less materials or labor and other clauses.
Work funded by insurance payments:
In the event the work is to be funded from insurance proceeds, the insurance company and Advance Insulation Canada shall agree upon the total price. Customer authorizes the Advance Insulation Canada to negotiate directly with the insurance company. Customer authorizes the insurance company to pay Advance Insulation Canada directly for all work performed/provided for herein. If the insurer refuses to fund necessary work, Advance Insulation Canada may terminate the Agreement.
Contractors required insurance:
The Contractor shall comply with all laws relating to Worker’s Compensation Board in the Province of Alberta and shall carry Contractor’s General Liability Insurance during the progress of the work.
No Guarantee:
There shall be not any guarantees or liabilities of Advance Insulation Canada after the work is completed, except as provided in any written warranty provided by the Advance Insulation Canada.
Spray Foam:
Customer accepts the responsibility of providing a workspace that is clean and free of debris which will be vacated absolutely before the application is initiated and for a minimum of 24 hours after the spray foam application has ceased. Advance Insulation Canada will apply the polyurethane foam to the desired surface; however, AIC is NOT responsible for any overspray on any surface, tools, materials, equipment, or other objects left in the area where foam application is meant to occur. All persons including, but not limited to, homeowners, inhabitants, tenants, guests, invitees, general contractors, subcontractors, inspectors, or anyone not wearing PPE (Personal Protection Equipment) is not permitted to access or inhabit the space for a minimum of 24 hours AFTER the application of spray foam. All SDS sheets are available at the customer’s request as well as on our website.

Advance Insulation Canada is not responsible for any injuries to any persons visiting, working, and or inhabiting the worksite during the spraying and 24 hours after.

Attic Insulation:
Please be advised that while working in confined attic spaces, damage to existing drywall on the ceilings below may occur. This is an unavoidable occurrence of working in attics over finished areas. If any damage is to arise from this work, AIC will provide a written quote to repair the damages. AIC is not to be held accountable for these damages, should they occur.
Payment Terms
Payment terms are NET 30 days. If an invoice has exceeded 40 days without prior arrangements being made, necessary action will be taken to ensure payment.
Cancellation:
Advance Insulation Canada reserves the right to cancel this contract if, upon re-inspection of the job, Contractor determines that it cannot perform its obligations due to a structural problem with the home, because work required to complete the job was not included in the contract, or because insurance will not pay for the work.
